The website is dedicated to the LGBTQ+ community, being a social networking website between members of this community (Content Creators, Fans) and at the same time, an app service that allows Creators to upload photos and videos to their profile and set prices for accessing that content, respectively allowing Fans to pay to access that content.
The www.thequeerly.com website contains adult-oriented content only and is not intended for minors. Only adults who are at least 18 years of age and who have reached the age of majority in the country in which they reside may access Thequeerly. If you do not meet these age requirements, you should not access Thequeerly and should leave now. The Company prohibits anyone who does not meet these age requirements from accessing Thequeerly.
Please read these Terms and Conditions, Cookie Policy and Privacy Policy before using the Website. By accessing and using the Website, you expressly acknowledge the binding nature of these documents and agree to abide by them.

ACCOUNTS
Fans: To register and create an account on Thequeerly as a Fan, you must provide a valid email address, a username, and a password, or authenticate using a valid social media account. If you desire to purchase content on Thequeerly, you will need to add a valid payment method. Thequeerly does not store any payment information.Creators: To register and create an account on Thequeerly as a Creator, you must complete the Creator registration process (on the Become a creator! Section within your account) and be approved by the Company in our sole and absolute discretion. If you desire to sell content on Thequeerly, you will also need to add a verified bank account (checking or savings) or other approved payment method, and submit additional legal information, such as a W-9 if you are a resident in the United States of America (the exact information required will depend on your country). Your earnings will be paid into your designated payment method via one of our payout processors or via direct bank wire. With exception to those Creators seeking payment via direct bank wire, which is stored by our third-party payout processors, Thequeerly does not store any bank account information.
Within your account you can also view your balance, the payments you have made, your purchases, your subscriptions, bookmarks, likes, referrals, you can create a Creator account (Become a creator!), you can switch to light mode and also on the Settings section you can access details about your account, modify your password, or explore options for deactivating your account.
SUBSCRIPTIONS
Within your account you can subscribe to available channels. To subscribe, you will need to use the payment method provided. Credit or debit cards, Mastercard or Visa are accepted.Within the account you can tip a creator. The minimum amount that can be sent is €5.
Within the account, you can chat with the creator via the Messages - Chats section.
Within the Signals section, you can see your new subscribers, likes and the new comments.
PAYMENTS
You can make payments to unlock content by using your credit or debit card (Visa/Mastercard). By subscribing to an account you can unlock the content shared by Creators and get full access to the user content, direct message with this user and you can also cancel your subscription at any time.In order to make the payment, you have to introduce your card number and the date on it MM/YY/CC. You also have to agree with this Terms and Conditions by click on the box that shows the following message „I agree with: Terms and Conditions”. The amount paid includes the processing fee (19%).
INTELLECTUAL PROPERTY
No part of the content of the Website in which the Company has an intellectual property right may be reproduced, distributed or published in any form, for any purpose or by any means without the prior written consent of the Company. Therefore, visitors to the Website declare that by simply using the Website they understand and consent not to copy, modify, sell, distribute, transmit, display, reproduce, publish or create works/works/derivatives based on the information published on the Website.WEBSITE USAGE
By using the Website you agree:a) Not to make any false or fraudulent request or purchase. If we have reasonable grounds to believe that you have made such a request or purchase, we have the right not to respond to it and to inform the relevant authorities accordingly.
b) Provide us with a correct and accurate first and last name, email address and/or other contact details. If you do not provide us with all the information we need, we may not be able to respond to your request or process your purchase.
By using the Website in any way and for any purpose, you declare that you fulfil the conditions laid down by law, i.e. that you have the capacity to enter into legal acts which give rise to the obligations laid down in the Terms and Conditions, Privacy Policy and Cookies Policy.
The mere use of the Website and/or the submission of a request via the forms on the website, and the response to this request does not bind the Company in any way towards the visitor/potential Fan/Creator, i.e. does not represent the conclusion of a contract between the Company and the visitor/potential Fan/Creator.
By means of the Website, the Company invites the visitor to the Website, i.e. the potential Fan/Creator to contract the services provided by the Company. The visitor or potential Fan/Creator shall contact the Company by using any of the contact details published on the Website and set out in point 1 of these Terms and Conditions.
LIMITATION OF LIABILITY
The Company shall not be liable for any damages whatsoever that a visitor to the Website, prospective Customer or any other third party may suffer as a result of the use of the Website in any manner or for any purpose or as a result of the Company's failure to comply with any of its legal and/or contractual obligations.The Visitor/Fan/Creator shall use the services offered through the Website entirely at his/her own risk. The Visitor/Fan/Creator is responsible for maintaining the confidentiality of the information transferred/received via the Website and for processing it in accordance with the legal provisions on the protection of personal data.
Information of any kind presented through the Website is provided by the Company in the form and content in which it was received or retrieved, without modification. The Company does not warrant and assumes no responsibility for the correctness, accuracy or timeliness of any such information.
OUR RIGHT TO CHANGE TERMS AND CONDITIONS
We have the right to revise and amend the Terms and Conditions from time to time in our sole discretion. It is your responsibility to read the Terms and Conditions, Cookie Policy and Privacy Policy in their entirety, as applicable, as updated at the time of your use of the Website.APPLICABLE LAW AND JURISDICTION
